TERMS AND CONDITIONS

Remedy & Root, LLC
Effective Date: September 7, 2026
Last Updated: September 7, 2026

The short version. Use of this site is subject to these terms. Our writing, frameworks, and assessment instruments belong to us. You are welcome to link to them, quote up to 200 words with credit, and share our free resources with colleagues. You may not republish them whole, put them in your own training materials or client deliverables, or use them to train an AI system without asking. Consulting work happens under a signed agreement, never through this site. Virginia law governs, and our liability is limited as described below.

1. Agreement

These Terms are a binding agreement between you and Remedy & Root, LLC, a Virginia limited liability company, governing your use of www.remedyandroot.com (the “Site”) and everything made available through it, including essays, newsletters, frameworks, diagrams, assessments, templates, recordings, and downloadable resources (together, “Content”).

By using the Site you agree to these Terms, the Privacy Policy, and the Website Disclaimer, each incorporated here by reference. If you do not agree, please do not use the Site.

2. Who May Use the Site

You must be at least eighteen (18) and able to form a binding contract. If you use the Site for an organization, you confirm you are authorized to bind it, and “you” means both you and that organization.

3. What You May Do Here

We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site and to use our free resources for your own internal, professional, or educational purposes. Nothing here transfers ownership, and all rights not expressly granted are reserved.

4. Our Intellectual Property

All Content belongs to Remedy & Root, LLC or its licensors and is protected by copyright, trademark, and trade secret law. The selection, arrangement, and methodology underlying our frameworks are themselves protected.

Remedy & Root, the R&R Integration Blueprint, the Community Integration Blueprint, and the Systems Integration Readiness Assessment (SIRA), along with our logos, wordmarks, and visual identity, are our trademarks and service marks, registered or not. Please do not use them without written permission, except to refer accurately to us and our published work.

5. Sharing Our Content

These rules are permissive about circulation and strict about substitution.

Welcome, no need to ask. Link to anything here and share the link anywhere. Quote up to two hundred (200) words from any single piece with clear attribution to Remedy & Root, LLC and a link back. Share a screenshot on social media as long as our branding stays intact and the post credits and links to the source. Cite our published work using standard citation conventions. Print or download free resources for yourself and your colleagues, branding intact, and forward a download link to anyone.

Please ask first. Reproducing a full essay or newsletter, in whole or substantial part, anywhere. Putting our Content, frameworks, diagrams, or assessment items into training materials, curricula, toolkits, or deliverables of any kind, paid or not. Translating, adapting, or creating derivative works. Using our Content in a proposal, grant application, RFP response, or client deliverable of yours. Any commercial use, including resale, licensing, or syndication. Write to tracy@remedyandroot.com with the Content, the use, the audience, and the timeframe. We say yes more often than not, and we say it in writing.

Not permitted. Removing or altering any copyright notice, trademark, branding, or attribution. Presenting our Content, frameworks, or methodologies as your own or your organization’s work. Administering, distributing, or earning revenue from our assessment instruments, or adaptations of them, outside a written license. Using our Content to build a competing framework, instrument, or methodology. Systematically scraping, harvesting, or copying the Site by automated means. Using any Content to train, fine-tune, ground, or develop any artificial intelligence or machine learning system, or providing it to a third party for that purpose, without our express prior written consent. Public accessibility of this Content is not a waiver of that restriction. Any use that is unlawful, infringing, defamatory, or that misrepresents our positions or affiliations.

Where we find unauthorized use, our practice is to ask first and escalate only if we must. Unauthorized use may still result in claims for infringement, injunctive relief, and recovery of damages and fees where available. Copyright complaints may be sent to the address in Section 15 under the Digital Millennium Copyright Act, 17 U.S.C. sec. 512.

6. Free Resources and the Email List

Free resources are provided at no charge, as is, without warranty, and may be changed or discontinued at any time. Downloading one may require an email address, which adds you to our list; you can leave it at any time using Section 4 of the Privacy Policy, and leaving does not affect a resource you already have. We may pause or restructure the newsletter at any time.

7. What You Send Us

You keep ownership of anything you send us. You grant us a non-exclusive, royalty-free, perpetual license to use and adapt it for the purpose of responding to you and running our practice. We will not publish it, quote you, or identify you publicly without your written permission. You confirm that what you send is yours to send, infringes no one’s rights, and contains no protected health information or third-party confidential information.

Please do not send unsolicited proposals, business ideas, or confidential concepts. We work continuously in this field and may already be developing, or may later independently develop, something that resembles what you send. Unsolicited submissions are received on a non-confidential basis, and we take on no obligation of confidentiality, compensation, or attribution for them.

8. Consulting Work Happens Under a Signed Agreement

Descriptions of our services on the Site are informational. They are not an offer, a quote, a proposal, or a commitment, and nothing here guarantees availability, capacity, price, or timeline.

A services relationship begins only when both parties sign a written consulting agreement, statement of work, or engagement letter, which then governs scope, deliverables, timeline, fees, payment, confidentiality, data handling, intellectual property, and termination. If that signed agreement conflicts with these Terms, the signed agreement controls for the services, and these Terms continue to govern your use of the Site.

9. Things You May Not Do

Please do not use the Site unlawfully, disrupt it or its networks, attempt unauthorized access to any system or account, introduce malicious code, use bots or scrapers, impersonate anyone or misrepresent your affiliation, harvest information about other visitors, send unsolicited commercial messages through it, reverse engineer any tool offered through it, or place an unreasonable load on our infrastructure. We may investigate suspected violations, cooperate with law enforcement, and end your access without notice.

10. No Warranties

The Site and all Content are provided “as is” and “as available,” without warranty of any kind, express, implied, or statutory. To the fullest extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that any Content is accurate, complete, or current. No advice you get from us, spoken or written, creates a warranty we have not stated here.

We depend on third parties for hosting, email, scheduling, and analytics, and interruption, error, data loss, or security failure originating with one of them is outside our control. We may modify, suspend, or discontinue any part of the Site at any time.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limit on Our Liability

To the fullest extent permitted by law, Remedy & Root, LLC, Tracy Steffek, and our members, officers, contractors, agents, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunity, or reputation, arising out of or related to the Site, the Content, or these Terms, under any legal theory, and whether or not we were advised such damages were possible.

Our total aggregate liability for all claims arising out of or related to the Site or these Terms will not exceed the greater of (a) the total amount you paid us through the Site in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

This limit does not apply to liability that cannot be limited by law, including fraud, willful misconduct, or gross negligence. Liability under a signed services agreement is governed by that agreement’s own limitation provisions, not by this section. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Remedy & Root, LLC, Tracy Steffek, and our members, officers, contractors, agents, and affiliates against any claim, loss, liability, damage, cost, or expense, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, the Privacy Policy, or the Disclaimer, your violation of any law or third-party right including intellectual property rights, your unauthorized use of our Content or instruments, or any decision you or your organization makes in reliance on Content. We may assume exclusive defense and control of any matter you are indemnifying, at your expense, and you agree to cooperate.

13. Governing Law, Disputes, and Time Limit

These Terms and any dispute arising from them or from the Site are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules.

Talk to us first, and this step is required. Before filing any claim, write to tracy@remedyandroot.com describing the dispute and the resolution you want, and negotiate in good faith for at least thirty (30) days. Most disagreements end here, at no cost to either side.

If that does not resolve it, either party may bring a claim in the Circuit Court of Loudoun County, Virginia, or in the United States District Court for the Eastern District of Virginia, Alexandria Division, which serves Loudoun County. Both parties consent to that jurisdiction and venue and waive any objection to it. Each party waives any right to a jury trial to the extent permitted by law, and, to the fullest extent permitted by law, claims must be brought individually rather than as part of a class, collective, or representative action. Either party may still bring a qualifying individual claim in the small claims division of the General District Court of Loudoun County, and either party may seek injunctive relief in court to protect intellectual property or confidential information.

Any claim arising out of the Site or these Terms must be brought within one (1) year after it arises, or it is permanently barred, except where a longer period is required by law.

14. Changes, and Other General Terms

We may revise these Terms at any time, and the Last Updated date shows the current version. For a material change we will post a prominent notice on the Site for at least thirty (30) days and, where we hold your email address, tell subscribers by email. Using the Site after a change takes effect means you accept it.

These Terms, the Privacy Policy, and the Disclaimer are the entire agreement between us about the Site, and do not supersede a signed services agreement, which controls as described in Section 8. If any provision is unenforceable it will be narrowed or severed and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in a merger, reorganization, or sale of assets. Nothing here creates a partnership, joint venture, employment, agency, or fiduciary relationship. Neither party is liable for delay caused by events beyond its reasonable control. By using the Site you consent to receive communications from us electronically, and agree that electronic communications and signatures satisfy any requirement that something be in writing, consistent with the federal E-SIGN Act, 15 U.S.C. sec. 7001 et seq., and the Virginia Uniform Electronic Transactions Act, Va. Code sec. 59.1-479 et seq. Sections 4, 5, 7, 10, 11, 12, and 13 survive termination.

We want this Site to work for everyone, including people using assistive technology, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you hit a barrier, tell us and we will get you the content another way.
